The father of a 21-year-old boy charged over the death of a 60-year-old man after a terrible accident occurred outside court.
The accident which occurred at around 2:30am on Monday at Blacktown, in Sydney's west, saw Gayan Dao's Toyota Carolla smash into a concrete wall.
Before witnesses were able to help Mr Dao, his car burst into flames.
Police charged Sivan Sharma during a bedside hearing but he was unable to attend his court hearing on Tuesday as he was still recovering, reported nine news
Mr Sharma's hearing at Paramatta court was for a number of charges including dangerous driving occasioning death, negligent driving causing death and not wearing a seatbelt.
Jayant Sharma struggled to speak to the media, pausing to catch his breath as he broke down.
'My family and I are deeply sorry for what happened to the man…a man has died.
'At the moment my boy needs help,' he said.
Firefighters who later arrived at the scene were unable to free Mr Dao who died in the burning car.
Mr Sharma was immediately taken to Westmead Hospital in a serious but stable condition under the guard of police.
The 21-year-old has also been tested for drugs and alcohol as police officers investigate the boy's individual circumstances before the collision, reported News Local.
'There appears to be some unusual circumstances. We will look at the whole lot,' he said.
'The driver was hit up the rear died at the scene and the vehicle burst into flames, very tragic for that family this Christmas period.
'We don't know the full circumstances, we do know an innocent person has died on our roads last night,' said Police Traffic and Highway Commander Assistant Commissioner John Hartley.
